Appellate Division of the Supreme Court of the State of New York, Second Department.

Judgment modified, on the law and the facts, by (1) reversing the conviction of murder in the second degree under the first count of the indictment, and the sentence imposed thereon, and the said count is dismissed, and (2) imposing a concurrent 7½- to 15-year term of imprisonment with respect to the conviction of assault in the first degree under the eighth count of the indictment. As so modified, judgment affirmed.
