This is another case involving South Dakota's Implied Consent Law. A hearing examiner for the Department of Public Safety ordered the revocation of defendant's license to drive because of defendant's refusal to take a blood test upon request. A circuit court judge affirmed the hearing examiner's decision to revoke the license for one year, concluding that there was substantial evidence to support the hearing examiner's decision.
