On December 31, 1974 defendant executed a written waiver of indictment wherein he acknowledged that he had been advised and was aware of his constitutional right to be prosecuted by indictment; that he knowingly waived that right; that he had been duly arraigned in Village Court, Watkins Glen, New York, and, further, that he had waived his right to a preliminary hearing after being fully advised of his rights (CPL 195.10).
