BRANCH, Justice.

Defendant assigns as error the failure of the trial court to allow his motion to dismiss on the ground that he had been denied a probable cause hearing.

After defendant's arrest on 4 March 1977, a probable cause hearing was scheduled to be held on 24 March 1977. The State was granted a one week continuance over defendant's objection, and on 31 March 1977, the prosecution informed defendant that the case would be bound over to superior court...
