Judgment reversed, on the law and as a matter of discretion in the interest of justice, and new trial ordered. This case arises out of an interfamilial conflict which had its origins in a fight between the defendant's lover and his wife. In order to redress an insult to his wife, defendant confronted his lover, Ossidenna Frazier Seabury, on April 26, 1975, and, after arguing with her, he struck her.
