The suit out of which this appeal arose began when plaintiff (John Tabor) filed a claim for damages against defendant (Clifton Hardy) in district court. Because the amount in controversy was less than $500, the matter was treated as a small claims action. Following a hearing at which both parties to the suit presented evidence, the district judge rendered a judgment in favor of plaintiff for the sum of $400 and costs.
