This case arises out of the filing of a complaint for damages for injuries sustained by the petitioner. A motion to dismiss, or in the alternative for summary judgment, was filed by the respondents. The district court granted the motion and the court of appeals affirmed. Colo.App., 568 P.2d 84 (1977). We granted certiorari and we now reverse the court of appeals.
