STATEMENT OF THE CASE

This appeal is based upon a judgment in a negligence action wherein plaintiff-appellee James Shelby Malone was awarded no damages, although the jury found against defendant-appellant Charles J. Read on the question of Read's negligence.

The trial court upon Malone's motion granted a new trial. Read appeals.
