Between 1969 and 1972 warrantless telephone surveillance of certain persons not parties to this action was carried out under authorization of defendant-appellee as Attorney General of the United States. As a result of this surveillance some conversations of the plaintiffs in these two consolidated cases were incidentally intercepted.
