After a jury trial, defendant was found guilty of delivery of heroin in contravention of MCL 335.341(1)(a); MSA 18.1070(41)(1)(a). The alleged delivery took place on October 29, 1974, between defendant and an undercover agent while two other people were present. Defendant was arrested on January 27, 1975.
