This is an appeal from a judgment entered in the Court of Common Pleas of Lucas County, pursuant to a jury verdict awarding plaintiff damages totaling $250,000.

On July 18, 1972, in a tavern known as "The Apartment Lounge," an off-duty Toledo policeman, Lawrence Edinger, shot and mortally wounded Thomas Neiswender. The handgun used by Edinger was being carried pursuant to Rule 11, Rules and Regulations of the Toledo Police Department. This...
