The defendant, John H. Wilson, was charged in an Information dated October 10, 1977, with having committed the offense of burglary in violation of Section 12.1-22-02 of the North Dakota Century Code. As a result of a jury trial which was held on the first day of November, 1977, Wilson was found guilty and thereafter on November 10, 1977, was sentenced to imprisonment in the state penitentiary for a period of two years.
