Order modified by (1) deleting therefrom the provision which granted the motion of defendant Malone and substituting therefor a provision that the motion is denied, and (2) deleting from the second paragraph thereof all language after the words "is denied", and substituting therefor the following: "as academic". As so modified, order affirmed, with $50 costs and disbursements.
