The appellant was indicted and convicted for robbery and sentenced to ten years' imprisonment. Appellant's court appointed trial counsel was also appointed to represent him on appeal.

The evidence presented by the state reveals that around 7:30 on the evening of September 29, 1975, the appellant robbed a Jitney Jr. convenience store in Leeds, Alabama. The defense was alibi. The ex-wife of the appellant testified that she had cardio-vascular surgery...
