Defendant claimed he was denied a fair trial. We agree with defendant's contention, as the verdict herein was not returned by a fair and impartial jury (People v McLaughlin, 150 N.Y. 365, 375; People v Crimmins, 36 N.Y.2d 230; CPL 470.15).
