Petitioner was the sole proprietor and operator of the Endicott Nursing Home, located at Nantucket Drive in Endicott, New York, when, on August 6, 1977, he was found guilty by jury verdict of one count of grand larceny in the second degree, a class D felony, in violation of section 155.35 of the Penal Law. In essence, his crime involved the theft of approximately $26,000 worth of Medicare payments to the Endicott Nursing Home, and shortly after his conviction he was notified...
