This is an action in assumpsit brought by an insurance carrier, Harleysville Mutual Insurance Co., against its insured, J. M. Forklift Service, Inc. Plaintiff alleges that defendant breached certain conditions of the insurance policy by refusing to sign an affidavit to a complaint against the Rohm and Haas Co.
