As so modified, judgment affirmed.

Defendant was sentenced to a term of imprisonment with a maximum of 10 years after his first trial, which resulted in a conviction of manslaughter in the first degree (the indictment had charged him with the crime of murder). That conviction was reversed by the Court of Appeals (People v Tai, 39 N.Y.2d 894) because of the failure of the trial court to charge the jury on the lesser included...
