This case comes before the court on appeal from a district court order granting the defendant's motion to dismiss under F.R.Civ.P. 12(b)(6). The complaint alleged that the plaintiff, Darryl R. Frey, was a home builder who, on March 1, 1977, was in possession of a number of properties upon which he was constructing houses.
