The defendant-appellant, Tommy Mothershed, was convicted of raping a 79 year old woman. In addition the jury found that he was guilty of using a firearm in the commission of this felony, and Mothershed was sentenced to 40 years imprisonment for the rape, enhanced by a one to five year term on the firearms charge.
