Appellant was convicted of second degree burglary (Pen. Code, § 459) after a trial by the court without a jury. Pursuant to the stipulation of counsel and with the concurrence of the trial judge, appellant made a motion to suppress evidence resulting from a search of appellant's car, which was heard during the trial and denied.
