This is an action by which the plaintiff Gangell seeks to compel the defendant New York State Teamsters Council Welfare Trust Fund (Fund) to pay certain hospital charges pursuant to the provisions of a document entitled "Your Health and Hospital Program of the New York State Teamsters Council Health and Hospital Fund" (plan).1
