McMURRAY, Judge.

Defendants were passengers in an airplane which crashed on Highway 60 between Gainesville and Dahlonega in Lumpkin County, Georgia. After the crash defendants, claiming they needed to get to a hospital, obtained a ride with a passing motorist. They took with them a large wardrobe locker (trunk). Before reaching the hospital the defendants asked the motorist to take them instead to a motel.
