A few months more than five years after their property was sold at tax sale to defendant, Harold K. Quinn, plaintiffs, Richard A. and Jannie Bennett Collins, filed suit to annul the tax sale, alleging no notice of the tax delinquency or sale was given to them and that they continued in possession of the property after the sale. Defendant denied plaintiff's possession, pled the five-year peremption of suits to annul tax sales,1
