This is an action seeking damages for personal injuries allegedly sustained by the plaintiff in a fall over a curb in front of a variety store owned by the defendant Frisoli as trustee of Frisoli Realty Trust (Frisoli) and leased to the defendant Cabral since 1965. At the close of the plaintiff's case the judge directed a verdict in favor of Cabral, and judgment was entered pursuant thereto. The jury returned a verdict for the plaintiff against Frisoli...
