McGREGOR, J.

The defendant was convicted at a jury trial of delivery of phencyclidine, a controlled substance, in violation of the Controlled Substances Act. MCL 335.341(1)(b); MSA 18.1070(41)(1)(b). The delivery which formed the basis of the instant prosecution was alleged to have occurred in the City of Warren on October 7, 1976.
