On December 18, 1966, David Swenson (appellee) while walking in Franklin County was struck by an automobile operated by Robert McGee. Pursuant to a negotiated settlement of his claim for personal injuries, appellee received $8,000 and signed, on November 24, 1970, a general and unconditional release without any reservations releasing any and all persons with respect to the injuries sustained in the automobile accident.*
