OPINION

WREN, Judge.

Plaintiff, National Housing Industries (NHI), seeks recovery of damages from the defendant, Collar, Williams & White Engineering, Inc., for alleged negligence and breach of contract in drafting plans and specifications for the design of a residential subdivision, and for the defendant's alleged fraud, misrepresentation and concealment of material facts with respect to the sale of the subdivision to NHI.1
