The appellee was apprehended by City of Gainesville police on September 8, 1977, and found in possession of less than one ounce of marijuana. He was charged in municipal court in the City of Gainesville with violation of the Georgia Controlled Substances Act (Code Ann. Ch. 79A-8, Ga. L. 1974, p. 221 et seq.).
