DeCARLO, Judge.

Willie James McGhee, Jr., was indicted in January, 1975, by the Montgomery County Grand Jury for first degree murder. The indictment, omitting the formal parts, reads as follows:

". . . The Grand Jury of said County charge that, before the finding of this indictment, WILLIE JAMES McGHEE, JR., whose name is to the Grand Jury otherwise unknown, unlawfully and with malice aforethought, perpetrated an act greatly dangerous to the lives of others...
