On July 13, 1977, defendant Roger Dutremble was indicted in the Superior Court, York County, on one count of criminal homicide in the second degree (17-A M.R. S.A. § 202 (Supp.1976)).1 Following a jury trial, he was convicted of criminal homicide in the fourth degree with a dangerous weapon.
