This is an appeal by relator Daniel T. Marshall from an action in the Common Pleas Court requesting a writ of mandamus and a mandatory injunction against the Civil Service Commission and from an appeal to the Common Pleas Court from a decision of the Civil Service Commission denying him a hearing. The Common Pleas Court rendered a judgment finding (1) that the probationary period for the position of firefighter in the division
