Plaintiff brought this breach of contract action on March 8, 1973, based on defendant Smith's refusal to perform under a contract awarded to him by plaintiff. Damages sought were $550,796.83, the difference between Smith's low bid and the next lowest bid. Accompanying the original bid was a performance bond issued by defendant American Casualty Company of Reading, Pennsylvania in the amount of $91,277.77 (5% of the Smith bid).
