This case arises out of a head-on collision between two motor vehicles. Following the accident, Steven J. Oevering, the alleged driver of one of the vehicles, was charged with criminal negligence and several other offenses. Over Oevering's objection, the trial court admitted the blood-alcohol analysis of a blood sample taken from him without his consent in the hospital emergency room.
