SCOTT, Justice.
This is an appeal from a judgment of conviction of first degree murder pursuant to Minn.St. 609.185(1), wherein it is claimed that there was insufficient evidence of premeditation and intent to kill, and that the trial court erred in refusing to grant a mistrial after the state introduced evidence of prior misconduct which was not covered in its Spreigl notice.
