Defendant was tried and convicted in a jury trial in Detroit Recorder's Court for one count of delivery of heroin, MCL 335.341(1)(a); MSA 18.1070(41)(1)(a), and one count of conspiracy to deliver heroin, MCL 750.157a; MSA 28.354(1). This appeal by right challenges the trial court's instructions on identification and alibi, and the validity of the conspiracy conviction.
