A jury in Sedgwick County convicted Ricky Jacques of having unlawful possession of heroin. The conviction was affirmed by the Court of Appeals. State v. Jacques, 2 Kan.App.2d 277, 579 P.2d 146 (1978). This court granted review in order to consider three questions presented.
