KOHLHOFF v. STATE

No. 76-359-CR.

85 Wis.2d 148 (1978)

270 N.W.2d 63

KOHLHOFF, Plaintiff in error, v. STATE, Defendant in error.

Supreme Court of Wisconsin.

Decided October 3, 1978.

Attorney(s) appearing for the Case

For the plaintiff in error the cause was submitted on the brief of Howard B. Eisenberg, state public defender, and Mel S. Johnson, assistant state public defender.

For the defendant in error the cause was submitted on the brief of Bronson C. La Follette, attorney general, and Pamela Magee-Heilprin, assistant attorney general.

HANSEN, J.

The defendant seeks reversal on two grounds: (1) The evidence was not sufficient to support the verdict of the jury, (2) the response of the trial court to the request of the jury for testimony clarification constituted reversible error. In the alternative, the defendant asks that the judgment of conviction be reversed and the case be remanded for a new trial in the interests of justice.
