Appellant, Arvin Don Allen, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Oklahoma County, Case No. CRF-77-1363, of the felony offense of Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor, Second or Subsequent Offense. Defendant was sentenced to five (5) years' imprisonment and fined One Hundred ($100.00) Dollars; and from said judgment and sentence he has perfected...
