CORNISH, Judge:

This is an appeal from the District Court, Tulsa County, where appellant, Stephen Kennard Trotter, hereinafter referred to as defendant, was convicted at a non-jury trial on November 10, 1976, for the crime of Unlawful Possession of Marijuana With Intent to Distribute. Sentence was set at eight (8) years in the custody of the State Department of Corrections and a fine of One-Thousand Dollars ($1,000.00) was imposed. From said judgment...
