DORIS, Justice.

This is an appeal from a judgment of the Superior Court denying an application for post-conviction relief.

On June 30, 1970, Nicholas A. Palmigiano was convicted in the Superior Court of murder and robbery. It is uncontroverted that the members of the jury which reached that verdict were not sequestered during the trial. Palmigiano appealed his conviction to this court. We affirmed. State v. Palmigiano, 112 R.I. 348,
