Lee Underwood was convicted after a jury trial of three counts of distribution of marijuana and sentenced to terms of imprisonment of seven, eight and ten years, respectively, the terms to run consecutively. On appeal we affirm the defendant's convictions but vacated the sentences and remanded for re-sentencing because information brought to light at the time of an earlier limited remand1 indicated that the severe sentences...
