MARCUS, Justice.

Carl I. Sykes and John Tasker were jointly indicted by the grand jury for the Parish of Orleans for the crime of distribution of a controlled dangerous substance, to-wit: heroin, in violation of La.R.S. 40:966. Sykes was separately tried by a jury and found guilty as charged. He was subsequently sentenced to life imprisonment at hard labor,1 which sentence was to run concurrently
