BRETT, Judge:

The defendant herein, Chris Paul Cook, Jr., was charged and tried to the court in the District Court, Cleveland County, Case No. CRF-76-430, with the offense of Unlawful Delivery of a Controlled Dangerous Substance, in violation of 63 O.S. 1972 Supp. § 2-401 B.
