PER CURIAM.

This case, before the Court upon Writ of Certiorari, concerns a Motion to Quash the Venire filed by petitioner, Braxton Lee Kittle. This case was previously before this Court, but was remanded to the Court of Criminal Appeals to determine whether Kittle proved fraud in the filling of the jury box or in the drawing or summoning of jurors. See Kittle v. State, S.C. 2608[MS], (decided January 6, 1978), Ala.Sup., 362 So.2d 1269
