HOWELL, Justice.

This is the second time this action to recover a real estate commission has been before this court. In the first appeal, we reversed a judgment for defendants and remanded the action for a determination by the trial court as to whether the defendants exercised bad faith in terminating plaintiff's listing agreement. Snyder v. Schram, 274 Or. 539, 547 P.2d 102 (1976).
