Plaintiff-appellant was a candidate for mayor of Maui County as a nonpartisan. After qualifying for inclusion on the ballot at the primary election, and before the primary election was held, appellant brought this action to test the provisions of the election law which established the criteria for inclusion of nonpartisan candidates on the ballot at the general election.
