Appellant was convicted of second degree murder and sentenced to fifteen to twenty-five years' imprisonment.

The evidence most favorable to the State indicates that in the early afternoon of August 20, 1976, appellant visited a neighbor, Robert Martinez, and mentioned that he was mad at one, Mrs. Collins, because he felt she had mistreated his children. He pulled a gun, stated that he could not miss with it, fired at a circle on a nearby...
