This case is here on the state's appeal from a Superior Court order granting the defendant's motion to dismiss an indictment charging him with extortion. The question raised by the appeal is whether the state may prosecute the defendant for extortion under the circumstances herein described without violating his right, under the double jeopardy provisions of the federal and state constitutions,
