On March 6, 1974, the defendant George A. Marshall was driving a brown four-door station wagon on Memorial Boulevard in Newport. His vehicle was stopped for speeding by an unmarked police car, and the defendant was arrested when marijuana was found on the floor behind the driver's seat.
